EVENTS - ASSUMPTION OF RISK AND RELEASE OF LIABILITY
By purchasing a ticket to, registering for, or attending any event hosted, organized, or promoted by Orchard ("Event"), you acknowledge and agree to the following:
Assumption of Risk. Attendance at any Event involves inherent risks, including but not limited to personal injury, illness, property damage, and loss, whether caused by the negligence of Orchard, other attendees, venue conditions, third parties, or otherwise. By attending an Event, you voluntarily assume all such risks.
Release of Liability. To the fullest extent permitted by law, you release, discharge, and hold harmless Orchard, its owners, employees, volunteers, contractors, and any venue or third party involved in hosting the Event, from any and all claims, demands, liabilities, injuries, damages, or losses arising from or related to your attendance at, or participation in, any Event, except to the extent caused by gross negligence or willful misconduct.
Venue and Third Parties. Events may take place at venues not owned or operated by Orchard. Orchard is not responsible for the condition, safety, or security of any third-party venue, nor for the acts or omissions of venue staff, security personnel, or other attendees.
Personal Property. Orchard is not responsible for lost, stolen, or damaged personal property at any Event.
Photo, Video, and Audio Release. By attending an Event, you consent to being photographed, filmed, or recorded, and grant Orchard a perpetual, worldwide, royalty-free license to use such photos, video, and audio for promotional, marketing, and archival purposes, without compensation to you.
Conduct and Right of Refusal. Orchard reserves the right to refuse entry to, or remove without refund, any individual who engages in disruptive, unsafe, or unlawful behavior at an Event.
No Refunds for Cancellation Beyond Our Control. Orchard is not liable for any loss or inconvenience caused by an Event being postponed, cancelled, or altered due to circumstances beyond its reasonable control (including weather, venue issues, or acts of third parties).
